Subject:- Guidelines for reprocessing of damaged fertilizers during transit- Regarding.

Sir,

                             As you are aware, Fertilizer (Control) Order, 1985 strictly prohibits the manufacture/import for sale, sell, offer for sale, stocking or exhibition for sale or distribution of any fertilizer, which does not met the standards prescribed in Schedule-I of fertilizer (Control) Order, 1985.  However, in case there is an unintended deterioration in quality during transit from factory/port to the godown due to natural calamities, to mitigate the hardship to the otherwise genuine manufacturer/importer of standard fertilizers, in exercise of the powers conferred under sub-clause (5) of clause 23 of Fertilizer (Control) Order, 1985, the following guidelines, terms and conditions are hereby prescribed for reprocessing of damaged fertilizers:-

Guidelines

1  It is mandatory that all fertilizers shall have to meet prescribed standards before their dispatch for sale from manufacturing units/Port (in case of imported fertilizers).

2. In case of deterioration in quality during transit, the manufacturer/importer, if he fulfills the conditions mentioned in clause 23(5) of Fertilizers (Control) Order, 1985, shall apply within a specified period to the Controller of Fertilizers (i.e. Joint Secretary (INM), Department of Agriculture & Cooperation, Krishi Bhavan, New Delhi, New Delhi) along with necessary details in the prescribed from as given in Annexure-I      

3.The Department of Agriculture & Cooperation after examination and if satisfied, may issue authorization letter (Annexure-II) with a copy to DOF and the concerned State Government for reprocessing in a specified time period.

4. The applicant after taking back the damaged stock in question from field, shall keep in the factory, at a separate place and conspicuously mention “Material for reprocessing”.  He shall inform to the State Notified/registering authority and also shall make necessary entry in the stock register duly authenticated by the State Government Fertilizer Inspector.

5. The applicant will reprocess the stock within a period of maximum one month.  After reprocessing, he shall keep the stock in a segregated place and conspicuously mention”Reprocessed material” and make necessary entry in the stock register and shall inform to the concerned State Notified/registering authority.

6.The State Notified/registering authority shall get the sample drawn from the reprocessed stock and analyzed by a notified laboratory.  If fund standard, shall allow for further distribution of this stock as a normal fertilizer.  He shall also intimate this fact to the Controller of Fertilizers in Department of Agriculture & Cooperation as well as Joint Secretary (A&M) , Department of Fertilizers,  Shastri Bhavan, New Delhi & shall authenticate the entries in the stock register of applicant.
